Agreement and the service
These Terms of Service are an agreement between you and Fred Web Systems LLC, a North Carolina limited liability company operating Lasting Lyrics as a division ("Lasting Lyrics," "we," or "us"). By submitting an intake form, selecting a package, using a private order link, or otherwise using this website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
Lasting Lyrics creates personalized songs from customer-submitted stories and creative direction. The service is intended for adults. If you are under the age of majority where you live, use the service only with a parent or legal guardian's involvement. The website is not directed to children under 13; do not submit a child's personal information unless you are the child's parent or legal guardian and the submission is necessary for the requested song.
Free preview and timing
A private 30–45 second preview is provided free after a complete submission, all required confirmations, and a reasonable review of the requested material. The 24-hour preview target runs from the complete submission; it does not guarantee a particular creative result or apply to revisions, final deliverables, artwork, lyric video, optional edits, or other extras. Needed-by and event dates guide planning but are not guarantees unless we separately confirm a written delivery commitment.
Package selection occurs only after the preview is available. There is no obligation to purchase, and submitting a story does not create a paid order.
Your submissions and permissions
You remain responsible for the content you submit, including names, pronunciations, dates, stories, photographs, reference materials, and other personal information. You represent that the submission is accurate to the best of your knowledge, lawful, and not knowingly defamatory, deceptive, abusive, infringing, or invasive of another person's privacy or publicity rights.
You represent that you have permission or another lawful basis to submit information about other people and any material you do not own. You grant us a limited, nonexclusive, worldwide permission to receive, store, review, edit, reproduce, perform, use, and share that material only as reasonably necessary to create, quality-check, support, and privately deliver your requested service. We do not use your story or finished work for public marketing without separate permission.
Do not submit Social Security numbers, payment-card numbers, medical records, passwords, or other highly sensitive information that the service does not need.
Creative process and limits
Your confirmed facts guide the creative work. Production may use structured creative direction, a paid third-party music-generation platform, other modern music tools, and human review. The full story and creative details you submit may be sent to the approved production provider as needed to create the song. Reference songs may communicate broad mood, tempo, energy, or instrumentation only. Requests to copy protected work, reproduce lyrics, imitate a specific person's voice, or create a misleading endorsement may be declined or revised.
We do not promise that a song will be entirely human-composed, absolutely unique, eligible for copyright registration, or free from similarities that occur independently or through general musical conventions. The Personal-Use License explains the rights included with delivery.
Packages, prices, taxes, and payment
The package, included deliverables, revision rounds, and price are the ones shown on the pricing and checkout pages at the time of selection. Prices are stated in U.S. dollars. Any applicable taxes, payment-provider disclosures, and final total will be shown before a live purchase is submitted.
Checkout identifies whether it is a live payment or a test. Live payments are processed through Stripe hosted Checkout, where you review the amount before confirming payment. A checkout explicitly labeled test or simulated does not create a real charge; never enter real card information into a test checkout.
Delivery, access, corrections, and revisions
Final files are made available through a private access link after the applicable payment and quality-review gates are complete. Preview and order links may expire, be replaced, or be revoked for security or operational reasons. Keep every private link confidential and contact us through the verified support address if access is exposed or lost.
Covered production corrections include wrong approved facts, pronunciation errors, missing approved must-include details, and serious audio or file defects. Preference changes, new facts or memories, genre or vocal-direction changes, and major rewrites are discretionary revisions subject to the selected package. The separate Refund and Make-It-Right Policy controls refunds and the available remedies.
Ownership and personal-use license
Unless a separate written agreement signed by us expressly says otherwise, delivery does not assign copyright ownership or grant exclusive worldwide rights. We intend to create customer deliverables only while the paid third-party provider tier that permits our intended commercial use is active for the account creating the song. Provider rights and copyright protection can change and are not guaranteed. To the extent we own or control rights in a delivered work, your permitted use is governed by the Personal-Use License. We retain the website, service materials, templates, production methods, and other materials that are not part of your purchased deliverables.
Acceptable use and suspension
You may not use the website or private links to reverse-engineer the service, bypass access controls, upload malicious code, impersonate another person, violate another person's rights, or request unlawful, harmful, deceptive, abusive, or infringing material. We may pause, refuse, or end a request when reasonably necessary for safety, privacy, legal compliance, security, or service integrity.
Disclaimers and limits
We will provide the service with reasonable care, but the website and private links may occasionally be unavailable, delayed, or affected by events outside our control. We do not guarantee uninterrupted access, a particular emotional or musical result, exact event timing, compatibility with every device or platform, or copyright registration or exclusivity.
To the fullest extent permitted by law, Lasting Lyrics is not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for loss caused by material you submitted, your failure to protect a private link, or an event outside our reasonable control. Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.
You agree to reimburse us for reasonable losses, claims, and costs arising from your breach of these Terms or from material you submitted without the rights or permissions represented above, except to the extent caused by our own unlawful conduct or negligence.
Governing law and general terms
North Carolina law governs these Terms, without regard to conflict-of-law rules. Any court proceeding must be brought in a court with jurisdiction in North Carolina, unless applicable law requires another forum. Nothing here prevents a consumer from using a legally available payment dispute, filing a complaint with a regulator, or asserting a non-waivable right.
We may update these Terms by changing the date above. Material changes will not retroactively change an order already accepted unless the law permits and the parties agree. If a provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, the Refund and Make-It-Right Policy, the Personal-Use License, and any order-specific written terms are the complete agreement about the service.
